Protection Plan Plus
Congratulations on your decision to purchase a new home. This is perhaps the largest, most important single investment you'll ever make, and we wish you many years of enjoyment. Your home is built to the highest standards of quality as set forth in the SSTD 10-99 Hurricane Resistant Residential Construction and the Wood Frame Construction Manual, and throughout the entire building process, your home is continually inspected and approved by your local building officials. Be assured that your home is finished with as much attention to detail as is possible for a home such as yours.
You will find that it is normal for there to be some minor imperfections and variations partly because your home has been built out of a number of natural products which may bend or settle or otherwise move around. Please understand that your builder has no control over these things. Over the life of your home, you will find several maintenance items that will require your attention. That's part of being a homeowner, but we trust that you'll enjoy your home more than enough to make it worth the work you put into it.
Your home is warranted in accordance to national residential construction standards. A copy of the specific standards of this warranty is herein attached. As part of our commitment to providing you with the highest level of customer service and satisfaction, we will contact you to schedule detailed warranty visits at 30 days, 3 months, and 11 months after closing. We want to make sure you and your home get all the attention you deserve.
Additionally, if at any time you find items that do not conform to these standards, please inform your builder as soon as possible. We promise to repair, replace, or pay you the reasonable cost for repair or replacement for any item that does not so conform. Unless otherwise stated, all listed items are covered by this warranty for one year from the date of closing (or date of completion of construction, whichever comes last). Appliances and other individual items (i.e., dishwasher, range, water heater, etc.) may be warranted by the manufacturer for one year or more. In addition, the parts of the heating/cooling system are covered by warranty for five years from the date of completed installation.
IMPORTANT! You must provide the builder with reasonable weekday access during normal business hours in order to perform the obligations under this agreement. If a problem occurs, take immediate action to curb the situation and inform the builder as soon as possible; failure to do so can lead to subsequent and/or excessive damage for which the builder will not be held responsible.
WARRANTY STANDARDS
- Cracks in block or veneer walls. Settlement cracks are common and should be expected within certain tolerances. Any cracks greater than 3/8 inch in width will be repaired by surface patching or pointing. Builder will not be responsible for color variations.
- Cracks in concrete garage floors. Shrinkage (hairline) cracks are common and should be expected within certain tolerances. Any cracks greater than 1/4 inch in width or vertical displacement will be repaired.
- Vertical or horizontal movement of concrete slabs at joints. Concrete slabs are engineered to move at expansion and contraction joints. No builder's obligation.
- Cracks in exterior slabs. Shrinkage cracks are common and should be expected within certain tolerances. Cracks exceeding 1/3" in width or vertical displacement will be repaired.
- Unevenness in interior slabs/floors. Slopes purposefully created for drainage are not covered. If the unevenness exceeds 1/2 inch in a 48 inch measurement, the effected area will be corrected.
- Concrete slab cracks which cause finished floor coverings to rupture. The problem will be corrected so that the defect is not readily noticeable. Builder will not be responsible for variations if any finished floor must be replaced.
- Powdering, scaling or pitting of concrete. If the problem is caused by erosion due to salt, chemicals, or unusual weather, the builder is not responsible. If the deterioration occurs under normal use and conditions, the builder will repair it.
- Water pockets in slabs. Water pockets exceeding 5/16" depth shall be corrected with latex or equivalent filler.
- Vertical or horizontal separation of stoops away from the house. Minor separation is normal; separation of more than 1 inch will be repaired.
- Ground settlement around foundation or septic tank. Ground settlement up to 6 inches should be expected and is a homebuyer's maintenance responsibility. If settlement exceeds such and/or disrupts water drainage from the house, builder will replace fill once. In all cases, the purchaser is responsible for the removal and replacement of shrubs, grass, etc.
- Lot drainage not functioning properly. After normal rainfall, water should not stand in yard for more than 48 hours, except in depressions where a longer period is common. No decision regarding coverage will be made while frost or snow or saturation exist on the ground. Builder is responsible for establishing the proper grades; after that, the purchaser is responsible for maintaining them.
- Water leaking in basement/crawl space. Dampness of area is common and not covered by this warranty. Actual leakage of water (actual flow and accumulation) will be corrected. Builder will not be responsible if the cause is improper landscaping, alteration, maintenance or negligence by the purchaser.
- Walls which bulge, bow or are out-of-plumb. All interior and exterior walls have minor differences. Walls bowing more than 1/4 inch within a 32 inch measurement (floor to ceiling or wall-to-wall) will be repaired.
- Roof leaking. The roof should not leak and no leaks should arise from flashings, except where snow and ice are allowed to build up. Prevention of such buildup is the purchaser's responsibility. All leaks not caused by such buildup or neglect or extreme weather conditions (hurricanes, etc.) will be repaired. Builder is not responsible for color variations.
- Leaks in gutters and downspouts. Gutters and downspouts should not leak. However, during heavy rains, overflow should be expected. The purchaser is responsible for keeping gutters and downspouts open and free from debris. Leaks not caused by purchaser's neglect will be repaired.
- Water stays in gutters. Builder will repair so that, if free from debris, the standing water depth will not exceed 1 inch.
- Faulty exterior trim workmanship. Separation between siding, masonry and trim should not exceed 3/8 inch. Siding, trim and masonry should be capable of excluding the elements. Builder will repair by caulking or other methods.
- Leakage of elements through attic vents. Even if vents are installed according to building codes, driving rain or snow may enter. This is not a defect. Builder will correct to meet applicable code requirements.
- Caulking shrinkage. Certain types of caulk can dry out and shrink. Replacement is a purchaser's maintenance item.
- Paint or stain peels or fades. Some fading is normal and is caused by weathering. Varnish or lacquer on the exterior will deteriorate quickly and is not covered by this warranty. Mildew and fungus on siding are caused by climactic conditions or nearby bodies of water and are not covered by this warranty. Defective areas will be corrected. Builder responsible only for matching color as closely as possible.
- Cracks in stucco-type wall finish. Cracks in stucco-type wall finishes are common and should be expected within certain tolerances. Cracks in excess of 1/8 inch in width will be repaired once.
- Vented fireplace: not enough draw or down draft. Trees too close to the chimney or high winds can cause down drafts. Some homes are extremely air-tight and a window may have to be opened to maintain an effective draft. If the problem is caused by improper construction or design, it will be corrected.
- Chimney separated from home. Some minor separation is normal and should be expected within certain tolerances. Separation in excess of 1/2 inch in any 10 foot measurement will be corrected by caulking or other measures.
- Fireplace brick cracking. Firebrick cracking is to be expected and will not be repaired. Cracks in brick veneer greater than 1/4 inch in width will be repaired.
- Buildup in chimney. Creosote seepage is caused by the buildup of creosote in the chimney flue which is the direct result of the materials and manner in which the fireplace or stove is utilized. Burning of non-seasoned wood or improper operation will greatly enhance this situation. Chimney flues should be cleaned regularly. Builder is not responsible for defects other than a code violation in construction.
- Warpage of doors. Some warping, especially of exterior doors is normal and is caused by surface temperature changes. Such warping, however, should not cause the doors to become unusable or allow entrance of the elements, and should not exceed 1/4 inch measured corner to corner diagonally. Interior doors may undergo some movement and settling as the house experiences its first heating and cooling cycle. Thereafter, builder will adjust doors once so that they close properly. Defective doors will be repaired or replaced and the finish matched as closely as possible.
- Shrinkage/splitting of door panels. Expansion and contraction is normal and may cause unfinished surfaces to appear. Some splitting is normal and should be expected within certain tolerances. If the split allows the entrance of light, it will be repaired.
- Glass breakage. This is not covered by this warranty. Property should be inspected prior to occupancy.
- Garage door malfunctions. Maintenance is purchaser's responsibility. The door will be repaired and adjusted to function as designed. Some entrance of the elements should be expected.
- Windows do not operate. Reasonable pressure should open and close windows. Condensation and frost on windows are caused by climactic conditions and living habits of the purchaser and are not covered by this warranty. Builder will repair defective windows as required.
- Drafts around windows and doors. Some draft is normal and can be corrected with storm windows. Defective weather-stripping and badly fitted doors and windows will be repaired, adjusted or replaced.
- Faulty interior trim workmanship. Some separation in moldings is normal and should be expected within certain tolerances. Excess separation will be repaired by caulking or other methods once and is thereafter a homeowner's responsibility.
- Wall or ceiling cracks. Hairline cracks and seam or tape cracks, along with other slight imperfections are normal and should be expected within certain tolerances. Nail pops are common and are due to contraction and expansion of lumber products. Nail pops and excessive cracks will be repaired only once by the builder. Builder is responsible for repainting only the affected area unless the majority of a wall if affected. Color will be matched as closely as possible.
- Cracking of ceramic tile. Cracking of grout joints is common and is a home maintenance item. Broken tiles due to faulty workmanship will be replaced. Builder is not responsible for discontinued patterns or colors or for variations in colors.
- Wallpaper or covering begins to peel. This warranty will not cover problems caused by negligence such as consistent use of the shower without the exhaust fan being on. Mis-matches of wallpaper edging are not covered. Peeling will be corrected by repair or replacement. Builder is not responsible for discontinued patterns or colors or for variations in color.
- Uneven joints in wooden floors. Squeaks and loose sub-flooring are usually passing conditions caused by lumber shrinkage or temperature changes and are not covered by this warranty unless caused by a defective joist in the floor system. Uneven joints resulting in ridges or indentations exceeding 1/4 inch (1/2" in carpeted areas) within a 32 inch area will be repaired.
- Sub-floor imperfections causing ridges. Minor ridges or indentations are common and should be expected within certain tolerances. Ridges or indentations in excess of 1/8 inch (measured with a straight edge perpendicularly over the ridge and the deflection measured no more than 3 inches from the ridge) will be repaired and affected floor covering will be repaired or replaced. Builder is not responsible for discontinued patterns or colors or for variations in color.
- Separation between finished floor boards. Some separation is normal and should be expected within certain tolerances. Separations exceeding 1/4 inch in width will be repaired by filling or repairing.
- Nails popping through resilient flooring. Nails which have broken through the floor covering will be repaired and the covering repaired or replaced in the area damaged. Builder is not responsible for discontinued patterns or colors or for variations in color.
- Floor covering becomes loose or bubbles. The affected area will be repaired or replaced. Builder is not responsible for discontinued patterns or colors or for variations in color.
- Gaps in seams of resilient coverings. Minor gaps are common and should be expected within certain tolerances. Gaps in excess of 1/8 inch will be repaired or replaced at the affected area. Builder is not responsible for discontinued patterns or colors or for variations in color.
- Gaps in carpet seams. Seams may be apparent. Gaps will be repaired so as not to be overly visible.
- Vanity or kitchen countertop chip or crack. Cracks or chips, including porcelain and fiberglass fixtures (such as tubs and showers), not reported to Builder prior to occupancy will not be covered by this warranty.
- Cabinet doors or drawers warp. Minor warpage is common and should be expected within certain tolerances. Warpage in excess of 1/4 inch from the face of the cabinet will be repaired.
- Cabinet separates from wall or ceiling. Some separation is common and should be expected within certain tolerances. Separation in excess of 1/4 inch will be repaired.
- Decks. Some separation between decking and rails is normal and should be expected. Cracking, twisting, and weathering of pressure-treated lumber is also normal and should be expected. Homeowner is responsible for regular water-seal maintenance.
- Pipes freeze and burst. Purchaser is responsible for maintaining suitable temperatures in the home to prevent pipes from freezing. Proper winterization is a homeowner's maintenance item. Builder will repair or correct if defect is caused by faulty workmanship or materials.
- Plumbing leaks or malfunctions. Leaks and malfunctions caused by faulty workmanship or materials will be corrected.
- Clogged drains and sewers. This is a purchaser's maintenance item. Builder will be responsible only in the cause is a defect in construction.
- Pipes noisy. Expansion and contraction caused by water flow will cause some noise which is to be expected. Loud, hammering noises in pipes will be corrected.
- Outlets, switches or fixtures fail. Defective outlets, switches or fixtures will be repaired or replaced.
- Circuit breakers kicking off. Builder will not be responsible if caused by overloads to the system.
- Insufficient heating/cooling. The heating/cooling system should be able to perform in accordance with the system standards. The system is warranted by the installing contractor for 5 years on parts and 1 year on labor.

ADDITIONAL NOTE
Please know that the builder makes no warranty on cosmetic details (cleaning, painting, wallpaper, etc.) or landscaping (trees, plants, shrubs, grass, etc.). Homebuyer is responsible for inspecting all such items prior to closing and agrees to accept all such items "as is" unless other agreement is made.
Builder will not be responsible for any work done by the buyer, either during the time of construction or after, or for the work of any subcontractor chosen by the buyer. Any alterations made to the dwelling or property may void this warranty. Builder shall not be responsible for any problems that arise as a result of any such alterations.
Furthermore, Builder cannot be held responsible for so-called acts of God, such as excessive snow, flooding, hurricanes, or other destructive weather conditions. Finally, the homeowner should recognize that owning a home is a big responsibility; the buyer must continually upkeep and maintain the home in proper order to insure its long-standing level of quality.
WARRANTY SUPPLEMENT
- Your home was built on a monolithic concrete slab (that means the concrete for the footings and the floor were poured at the same time) using fiber-reinforced concrete and reinforcing steel rods. It is a wood frame construction with the exterior sheathing being 7/16” oriented strand board (OSB) covered with insulated house wrap. The entire structure is nailed, bolted, and strapped together in such a way as to provide a high degree of protection against high winds.
- Your home is insulated with R-13 fiberglass batts in the walls and R-30 blown insulation overhead (do not compress attic insulation; doing so will lessen its effectiveness). The roof is covered with #15 felt and 30-year architectural shingles with a shingle vent at the ridge.
- Your home was pretreated for termites at the time of construction by Southeastern Exterminating, Inc. In order to maintain your coverage against termite infestation, you will need to renew the termite bond every year. You have the choice to use any company you wish for continued coverage, but Southeastern is very thorough about inspecting and retreating every year. They can be reached at 639-3481.
- Your electrical power is supplied by Alabama Power. If you have not already changed the service into your name, you can contact them at 1-800-245-2244.
- Your water is supplied by South Alabama Utilities. If you have not already changed the service into your name, you can contact them at 649-4317.
- If you have natural gas, it is also supplied by South Alabama Utilities. You may need to give them a deposit before they will set a gas meter. When they set the meter, they will usually come inside and do a startup on the fireplace logs (watch so you’ll know how it’s done; directions should also be attached to the unit). The gas logs are designed to be very efficient. They will actually put heat into the home, and they do not require outside ventilation. They are supplied by Mobile Gas and have a four-year warranty.
- Your home has been pre-wired by Home Logic for telephone, television, surround sound, and security. Telephone: You will need to contact Bellsouth at 1-888-757-6500 to establish telephone service. Their technicians will need to run a service line from the street and connect it to the line from your house. You or the technician can connect other lines if you wish to have more than one phone line. Television: The television cable wire has been run to several rooms and ran to the outside of your house. There are perhaps several cable or satellite companies that service your area. Surround Sound: The pre-wiring has been done for surround sound, but it is up to the buyer to obtain a system if so desired. Home Logic can provide and install a system for you, or they can probably tell you where the wires are, and you can buy and install a system yourself. Security: The pre-wiring has been run to every window and door throughout the house. Call Home Logic at 666-4663 to get a price to complete the system. If
- you wish, you can subscribe to a monthly monitoring service.
- There are two electrical circuit panels for your home. The outside panel is placed on the side of your house with the power meter. It contains the large breaker switches for items such as the dryer receptacle, the range receptacle, the outside air conditioner unit, the inside heat/air unit, and the inside circuit panel. The inside panel is usually located in the garage or the laundry room. It contains the breaker switches for all the lights and receptacles throughout your home.
- You will find special GFI electrical outlets located in various places inside and outside your home. Every circuit in an area that could possibly get wet (kitchen, bathrooms, outside) is required to have a separate GFI outlet. If any outlet on that circuit gets wet, there is a separate breaker button on the GFI that will kick off. You will need to push the reset button to restore power to that circuit.
- If you have recessed lighting in your home, sometimes there is a situation with the light going off by itself and then coming on again by itself. This is generally caused by a lack of air flow around the fixture causing overheating. This is generally solved by removing the overhead blown insulation from the immediate area above and around the fixture.
- You will find several smoke detectors located throughout your home. They are all electrically wired and connected to one another (if one sounds, they all sound). They also have batteries which should be changed annually for your protection. You should also press the test button regularly to ensure that they are working properly.
- Your home may have been wired for easy connection to a backup power generator. If so, you will find a transfer switch located by the outside power panel. The connection cable is usually found in the garage. The wiring for such is typically confined to the inside power panel allowing the use of items such as lights, fans, refrigerator, etc., but not the double-breaker items in the outside panel such as heat and air conditioning, range, or dryer. Please make sure you read all necessary manuals and follow all instructions carefully to avoid injury to yourself or utility workers. If you have problems with this or any other electrical item in your home and are not able to contact the builder, the electrical contractor on your home is Jim Anthony; he can usually be reached at 554-9193.
- The water heater is located either in the attic or in a closet. You may wish to adjust the temperature to which it heats the water. You might also wish to adjust it or turn it off whenever you are going to be away from your home for an extended period of time (to save energy). There are also disconnect valves to and from the water heater, but they should never be turned off while the water heater is in operation.
- Near your water heater (or perhaps in the laundry room) you will find a water distribution panel similar to an electrical panel. There is a disconnect for every individual plumbing fixture throughout the home. In case of a leak, please shut off the water immediately and dry up any residual water. One common situation in new homes is that of debris in the water lines causing water flow to be restricted. Call the builder to arrange for repairs. In case of emergency, the plumbing contractor is Jim Evans, and he can be reached at 461-4141 or 487-4027.
- Your heat/air system is a Rheem 13 Seer Heat Pump professionally installed by Estes Heating & Air Conditioning (you may have two separate units if your home has more than one floor). There is a compressor unit that is placed outside and an air handler unit that is placed in the attic and is connected to the ductwork. The two-stage automatic thermostat is usually located in the hallway, and there is a return air grill installed nearby. For best efficiency, it is recommended that you change the return air filter once a month. Your system is custom designed for your home, but it may need to be modified if you have certain areas that remain too warm or too cool. For this or any other problem, call the builder. If need be, the office for Estes Heating & Air Conditioning can be reached at 443-7837.
- The main plumbing drain for your home is connected to the Mobile Area Water & Sewer System via an electric pressurized grinder pump. There is a tank in the yard into which everything drains, and a pump inside the tank quietly and efficiently discharges it to the sewer system when it is filled. There may be a 2” vent that sticks up above the tank. An electric panel box for the pump is mounted to the side of your home.
- There are two things you need to watch for in connection with the sewer pump. First, there is a red warning light on the box that will come on in the unlikely event that the tank is full but the pump is not properly working. Second, a safety valve is installed to the exterior cleanout that is designed to let waste come out into the yard rather than backing up into the house. If either of these two events occur, you must immediately cease allowing any water to drain from your home, and you need to contact the builder. If he is not readily available, you can contact the electrician, Jim Anthony, at 649-4930 or 554-9193 and explain the situation to him. (Please also know that the pump will not work during power outages.)
- Exterior door locks can sometimes become weathered or otherwise affected so that it becomes difficult for a key to be inserted. Spraying WD-40 inside the lock usually solves this problem. Additionally, both exterior and interior door knobs and locks can become loose from use. You may need to tighten the screws occasionally. Keys to the interior locked knobs can usually be found on top of the door casing.
- The garage door tracks may need to be lubricated occasionally to maintain smooth opening and closing. The batteries on the remote controls may need to be changed occasionally. The code for the garage door remote keypad is typically set at 1-2-3-4; directions for changing this code to your own preferred number are found in the lid of the keypad.
- The wall paint is an eggshell or satin latex, and it is supposed to be reasonably washable. The trim paint is usually semi-gloss and is also washable. When the painting contractor is through, he generally leaves some of both the wall paint and the trim paint for any touch-ups you might find or create after you move in.
- There are various ongoing maintenance items for you as a homeowner. There are several places inside and outside your home where acrylic or silicone caulking has been applied. Caulking regularly shrinks and needs to be reapplied to remain effective. You should look for such needs around all interior and exterior wood moldings, as well as at corners of the vinyl and metal exterior trim, and also around the windows. Additionally, if you have any exterior doors made of wood, you need to reapply a coat or two of polyurethane every year or so to maintain the condition of the wood. Steel doors with plastic inserts may need to be painted when necessary to prevent cracking.
- The windows installed in your home are deluxe vinyl windows purchased from Jemison
- Window & Door. The bottom sash is designed to tilt inward to make cleaning easier. Undo the two latches on top of the bottom sash (as you would to raise the window), and then slide inward the two latches found on the sides of the top of the bottom sash. The window will tilt and rotate on two pins on the outside of the bottom of the sash. Make sure the two side latches catch when returning the window to its normal position. Should you ever need to contact Jemison regarding replacing broken windows or for anything else, they can be reached at 633-4260.
- It is normal for various settling and other changes to occur as your home ages and goes through various climate conditions. Such changes may sometimes prevent doors from closing properly. It is recommended that you wait through an entire heating and cooling cycle before seeking to adjust these doors. This allows your home to adjust and arrive at a reasonably permanent condition, and thus any necessary adjustments need be made only once.
- There may be times that the humidity level in your home is higher than usual. This may lead to some condensation on windows or other such conditions. Running one or more bathroom exhaust fans for a while will usually help to alleviate this situation.
- Your kitchen and bathroom cabinets are made of quality wood (usually alder or oak) and are custom built by Carlsen Custom Cabinets. The bathroom cabinets typically have cultured marble tops, and the kitchen cabinets may have Wilsonart laminate tops or some kind of solid surface tops (i.e., Avonite, granite, etc.). The kitchen wall cabinets have adjustable shelves. Since they are made from real wood, there may be some movement or shrinkage due to climate conditions. Please call the builder or the Carlsen office at 649-3481 for any needed repairs or adjustments.
- Your carpet is of very good quality and is warranted by the manufacturer, but it must be cleaned regularly and properly to maintain its quality and warranty. Manufacturers recommend that your carpet be vacuumed at least twice a week and professionally cleaned every 12-18 months. Failure to regularly and properly remove dirt, sand, and grit from your carpet will greatly increase the wearing of the carpet.
- Your home may have hardwood flooring; if so, it is a multi-ply engineered hardwood. It is not a composite of other materials; it is all oak hardwood engineered in layers (perhaps engineered and manufactured similar to how plywood is made). It is the best choice of hardwood product to be installed on a concrete slab floor. Because this floor is genuine natural hardwood, it is therefore susceptible to scratches and indentations. The consumer ought not to expect that a genuine wood floor would be as durable as synthetic products (laminate floors such as Pergo brand). It has a very durable factory finish consisting of several coats of aluminum oxide and urethane specially applied and UV cured. The finish should retain its appearance for many, many years. Since engineered hardwood floors with factory finishes are relatively new, there has not as yet been much need or concern expressed regarding putting a further finish on them. Nevertheless, in the event that a consumer did desire to add an additional finish
- to the existing floor, he should know that some products may require sanding of the existing floor, and naturally any removal of the existing finish would void the warranty. In order to maintain the warranty, the consumer would need to use a product that is designed to be applied directly onto the existing surface without needing to do anything special in order for it to adhere properly.
- Your ceramic tile floor was installed in such a way as to reduce the likelihood of cracks in your floor as the slab underneath goes through changes as it continues to cure. Your floor is also installed with stain-resistant grout, but there still remains a need for proper care. Anything with dye (i.e., Kool-Aid, etc.) should be removed from the floor as quickly as possible. Should you be concerned about other factors that might require additional protection, you might wish to purchase and apply a product that is supposed to make the grout stain-proof (Lowes carries a product that you can easily spray on the grout). Any normal floor cleaning products can be used to clean the tile floor, but do not use aggressive products such as ammonia, and do not use bleach unless the grout is white. - Your yard has been carefully raked and sodded with centipede grass (and possibly overseeded with annual rye during the fall/winter time). Remember that the builder makes no warranty on any landscaping. It is the responsibility of the homeowner to properly water and care for the yard and plants. If your home came with a yard and landscaping sprinkler system, you need to acquaint yourself with the controller (usually installed on a garage wall) and schedule its use as you think best (in correlation with rain or other factors) for your new yard.
- You will probably find in a cabinet drawer some booklets and manuals for various items that have been installed in your home (i.e., fireplace, ceiling fans, microwave, etc.). You may wish to keep them for future reference and further information about these items.
- Once the deed to your home has been recorded, you will need to make an assessment with the office of the Revenue Commissioner.
